These "Palette Terms of Service" (hereinafter "Terms") set forth the conditions of use for Palette (hereinafter "App") provided by Yuto Kuwabara (hereinafter "Provider"). Any person using the App (hereinafter "User") must agree to and comply with these Terms. If you do not agree to these Terms, please stop downloading, installing, or using the App. By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

Article 1: User Responsibilities and Rights

Users agree to use the App at their own responsibility and to bear full responsibility for any acts that violate obligations under these Terms, all acts performed through the use of the App, and any damages arising from such acts (including damages that may be incurred by the Provider).

The User's right to use the App is non-exclusive, and Users may not sublicense, transfer, or otherwise assign their rights or contractual position to any third party.

Users are responsible, at their own expense, for preparing and maintaining the devices (including smartphones and tablets) and network environment necessary to operate the App.

Article 2: Fees

The Service shall in principle be provided free of charge.

If the Provider requires payment for use of the Service, the Provider shall notify Users in advance and obtain their consent.

Article 3: Intellectual Property Rights

All rights, including copyrights, trademark rights, and portrait rights, relating to all data, text, audio, video, illustrations, information, and the App itself provided through the App belong to the Provider or to third parties holding such rights.

Article 4: Prohibited Acts

Users must not engage in any of the following acts when using the App. If the Provider or any third party suffers damages due to a User's violation, the User shall be liable to compensate for such damages.

Article 5: Disclaimer

The App is provided "as is." The Provider makes no warranties of any kind regarding the completeness, usefulness, operational guarantee, fitness for a particular purpose, compatibility with the User's device, or any other aspect of the App. The Provider shall not be liable for any damages suffered by Users or third parties due to communication failures, defects or failures in system equipment, or use of the App.

If the App calls or uses the functions of another app as a result of the User's operation, the Provider shall bear no responsibility whatsoever for the specifications, operation, or effects of such other app.

Article 6: Modification, Suspension, or Termination of the App

The Provider may, without prior notice to Users, modify the content, display, operating methods, or management of the App, or suspend or terminate the provision of the App. In such cases, the Provider shall bear no responsibility for any events arising from such modifications or suspensions.

If a User violates any provision of these Terms, the Provider may, without any notice, terminate these Terms with respect to that User and discontinue that User's access to the App.

Article 7: Amendment of These Terms

These Terms may be changed without prior consent from Users and without advance notice. If a User continues to use the App after any such change, the User shall be deemed to have agreed to the revised Terms.

When these Terms are amended, the Provider will notify or inform Users by posting within the App or by any other method the Provider deems appropriate.

Article 8: Handling of Personal Information

The Provider shall handle personal information appropriately in accordance with its Privacy Policy. Personal information collected by the Provider shall be limited to what is necessary for providing, operating, developing, improving the Service, and supporting Users, and the Provider shall not collect personal information beyond what is necessary without the User's consent.

Article 9: Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. In the event of any dispute between the Provider and a User arising in connection with these Terms or the App, the Tokyo District Court shall be the exclusive court of first instance by agreement.
